Domain name disputes can also be resolved through litigation in federal court. The Anti-cybersquatting Consumer Protection Act, or ACPA for short, is a United States federal law codified as 15 USC §1125(d). The ACPA was enacted in 1999 to provide a federal cause of action for cybersquatting.  

Penalties under the ACPA are serious; much more serious than under the UDRP. In addition to recovering the infringing domain name, a person who is liable for cybersquatting under the ACPA can also be responsible for statutory damages up to $100,000 and attorney fees.   

As a trademark owner, it can make sense at times to file an ACPA lawsuit rather than a UDRP complaint. And as a domain name owner, if you are served with an ACPA lawsuit you could potentially lose much more than just the domain name. Whether you are a plaintiff or defendant, when ACPA litigation is a possibility, you need an experienced ACPA lawyer.
